Much of Hyatt’s work is in the area of consulting engagements with nonprofits. For instance, he often finds himself working with nonprofits on projects like bylaws development and revision, conflicts of interest, fiduciary duty, senior management compensation and benefits, and other efforts where the topics described in the Standards for Excellence: An Ethics and Accountability Code for the Nonprofit Sector® and his Standards for Excellence® Licensed Consultant training prove to be beneficial. Hyatt’s engagements typically involve providing educational presentations to boards of directors, facilitating board discussions and retreats, and leading in-service training programs.
A frequent speaker, Hyatt has given presentations during national and regional conferences for groups such as: BoardSource, the Association of Governing Boards of Universities and Colleges, Commonfund, American Health Lawyers Association, and various state bar and CPA associations. He has also served as a guest lecturer at the University of Pittsburgh School of Law, Georgetown University Law School and the University of Maryland Law School.
He often finds himself referencing the Standards for Excellence® code when speaking or presenting on issues such as good governance practices, transparency, the new IRS Form 990, executive compensation in nonprofits, and the nonprofit regulatory landscape. He also trains and speaks on issues like the legal aspects of board service, mergers, and joint ventures.
Of the comprehensive Standards for Excellence® program resources, Tom finds that he consistently turns to the Standards for Excellence: An Ethics and Accountability Code for the Nonprofit Sector to supplement his own materials, professional background and expertise. Hyatt encourages other attorneys working on engagements of a nonprofit consulting nature to consider the Standards for Excellence® Licensed Consultant Program as a worthwhile resource for their professional development. Key Foundations Uses the Standards for Excellence® To Build from the Ground Up “When we first encountered the Standards for Excellence®, we didn’t have any programs. We had not even received our exempt status,” says Carolyn Myer, executive director. “But we wanted to use these standards to build our framework for operating. When it was time to apply for state licensing and federal grants, we already had the policies in place that the government agencies required. We were able to establish and grow our services much quicker and easier as a result.” Myer gives much of the credit to Louisiana Association of Nonprofit Organizations, where her staff, board members, and volunteers took countless Standards for Excellence® courses and received hours of one-to-one technical assistance focusing on the areas that needed the most attention -- designing a program evaluation system and refining their fundraising, finance, and legal policies.
“As a young nonprofit, it is hard to imagine how larger, more established nonprofits are able to operate well, not having the practices and policies in place recommended in the Standards for Excellence® Code,” says Myer. “Nonprofit managers, especially in the faith-based community, have the heart but we don’t always know how to operate our organizations as businesses. The Standards for Excellence® helps a great deal with this.”

Our board of directors has recently approved changes to the Standards for Excellence: An Ethics and Accountability Code for the Nonprofit Sector®. Most notably, the threshold for recommending an audit by a Certified Public Accountant has been raised from $300,000 per year in annual revenue to $500,000 in annual revenue. In addition, a clarification has been made in the standard related to mission statements and states that the mission statement should be formal and state the organization’s purpose. The Standards for Excellence® code now also includes a statement encouraging nonprofits to periodically review both their personnel and financial policies.
